Fernanda StefaniIdnan Deen
Fernanda is an experienced solicitor in all matters involving Mental Capacity Law & Mental Health Law.
This includes representing clients in any disputes regarding mental capacity arising in the Court of Protection, including s21A matters under the Mental Capacity Act 2005.
Fernanda is experienced in applying for deputyships of both finance and property as well as health and welfare. She is knowledgeable in preparing Lasting Powers of Attorney (LPA) and dealing with any legal disputes that arise regarding LPAs and Enduring Powers of Attorney (EPA). Fernanda regularly assists clients who no longer have the mental capacity required to make important decisions regarding their finances, health or welfare. She has extensive experience in Deprivations of Liberty Safeguards procedures and Declarations of Best Interest. Fernanda regularly assists patients, family members and carers who are in dispute with statutory authorities, ensuring that all involved are represented in often sensitive cases.
Fernanda also specialise in Mental Health Law. She is a member of the Law Society’s Mental Health Accreditation Scheme. Fernanda is fluent in Italian, Spanish and Portuguese and is proficient in French.
Fernanda provides advice and representation in regards to all aspects of the Mental Health Act 1983 including civil and forensic sections. In addition to assisting patients, Fernanda also provides legal advice and representation to relatives of patients.
Fernanda is specialised in challenging lawfulness of detention, appealing decisions of the First Tier Mental Health Tribunal to the Upper Tier Mental Health Tribunal, commissioning independent psychiatric and social circumstances reports, and challenging the decisions of Primary Care Trusts by way of judicial review. Fernanda always works to ensure the best possible outcome for her clients.
